Special retirement: be aware of the documentation to guarantee your right!

Medical professionals are exposed to various risks in the exercise of their function, such as biological and physical risks, such as exposure to equipment that emits radiation. For this reason, they are entitled to special retirement.   However, as it is often obtained only through the courts, it is important to know the necessary steps and prepare yourself, remembering that success often depends on the quality of the documentation presented.   What makes this type of retirement special are the advantages it offers, given that the doctor has daily contact with agents who put his life at risk. In addition to the fact that it takes less time to prove work to guarantee retirement, the salary is full, that is, the retired doctor will not have future discounts due to age, being free of the social security factor.   The other big advantage is that you don't need to be the minimum age to apply for special retirement, that is, even at a young age, the right is maintained.   If the doctor meets the requirements for granting special retirement, he has the right to receive it, regardless of the type of employment relationship, although there is a set of evidence to produce for each type.
  • Self-Employed Physician who serves only individual clients;
  • Physician Employee of a private company, health institution or cooperative member;
  • Self-employed physician who provides services to a health institution;
  • Physician Employee of Public Bodies;
  • Physician Contested in Public Bodies.
Documents required for the process:
  • Graduation and specialization diplomas;
  • Registration number in the CRM and card with registration date;
  • Evidence of activity under special conditions in medical facilities and not in administrative areas, such as the LTCAT and the Professional Profile (PP or PPP), or other types of evidence.
There is also a list of documents that prove unhealthy conditions for each type of work. If the doctor performs his duties in two different services, he will need to gather and present the documentation relating to both jobs.  In addition to this documentation, it is necessary, for each case specified below, the following:  For the Self-Employed Physician who serves only individual clients:  INSS Collection Booklet  Evidence that you have a practice (any type of proof)  For the Autonomous Physician who provides services to a health institution or cooperative:  History of Amounts Paid for Services Provided  List of INSS withholdings made or all service delivery invoices since 11/1999;   For the Physician Employee of a private company, health institution:  Employment Card or service contracts;   For the Physician who has been admitted to Public Bodies:  Nomination and Dismissal Ordinances;  Financial Statements since 07/1994;  For the Physician Employee of Public Bodies;  Nomination and Dismissal Ordinances;  Financial Statements since 07/1994;  To apply for retirement, the physician affiliated with the INSS must attach the documentation and file the appointment with the INSS by telephone 135 or via the internet and appear at the social security agency on the established date and time. This process can also be carried out by a social security lawyer equipped with a power of attorney, documents and a copy of the client's RG.  When the doctor is a public servant and his employer has his own social security system, the professional must go to the human resources department of the public body where he works to apply for retirement.  “It is important for doctors to remember that every effort is valid, given that it is a right. In addition, the recommendation is that the entire process be done in conjunction with a specialized lawyer. The INSS denies the majority of requests precisely because the documentation is defective”, adds Dr. Fabrício Angerami Poli, CBR legal advisor.
